Definition and declaration.
The environmental protection area is established under the National Environment Preservation and Promotion B.E. 2535, specifying environmental protection area into 2 cases as follows: The announcement of environmental protection area under Article 43 includes watershed areas, natural ecological areas, the fragile areas that can be damaged or affected easily by human activities, and the areas that are naturally and culturally valuable for conservation. The announcement of environmental protection area under Article 45 includes a conservation area, a master town and country plan area, s specific town and country plan area, a building control area, industrial estate, a pollution control area. These areas have been adversely affected by environmental problems which assume a critical proportion to such an extend that an immediate action has become imperative and yet no action is taken by government agencies concerned to rectify the situation due to a lack of clear legal authorization or otherwise failure to do so, such areas must be declared as the environmental protection area by section 44 in order to control and solve the problems.
