Definition and declaration.

This kind of protected area is the area for the management of fishery resources by virtue of Article 32 of Fisheries Act B.E. 2490 (amended in B.E. 2496 and B.E. 2528), providing rules for fisheries which are suitable for the conservation of aquatic animals. The establishment of controlled fishing areas in Thailand is supported by many regulations which consist of the notifications and regulations of Ministry of Agriculture and Cooperatives and the provinces. These notifications are announced by virtue of the Fisheries Act B.E. 2490 which is legally effective in Thai waters. The Fisheries Licensing and Management Measure Section, Fisheries Management Bureau, Department of Fisheries have collected and categorized the regulations concerned with the controlled fishing area into nine categories (As shown in Table) for fishers and relevant sectors to easily understand such regulations and its adoption. Additionally, the European Community has announced the “Council Regulation (EC) No. 1005/2008 of 29 September 2008 establishing a community system to prevent, deter and eliminate illegal, unreported and unregulated fishing”, became an effective as form 1 January, 2010. According to this regulation, any marine fishery products, harvested from the sea, which to be exported to the European Community must be officially certified that such products are derived from legal, reported and regulated fishing.

The protected area established under this Article 32 is divided into 2 types that are 1) prohibition of certain kinds of fishing gears in spawning and breeding season for some economic aquatic animals, and 2) prohibition of certain kinds of fishing gears in some localities.
